The Court of Appeal has dismissed an appeal filed by Labour Party factional leader, Julius Abure, regarding the party’s leadership dispute, affirming the earlier ruling of the lower court.

In its judgment delivered today, the appellate court held that the Nasarawa High Court judge who issued an interim order against the interim leadership committee acted recklessly and without jurisdiction.

The court further ruled that the constitution of the Labour Party’s interim committee remains an internal affair of the party, and therefore outside the jurisdiction of the court in the matter brought before it.

According to the judgment, the substantive suit at the lower court was against the Independent National Electoral Commission (INEC), and did not concern the internal affairs of the Labour Party.

The Court of Appeal therefore upheld the decision of the lower court, describing Abure’s appeal as lacking merit, and awarded a cost of N10 million against him.
