The legal team representing former Senate President, David Mark, has formally urged the Supreme Court of Nigeria to urgently deliver judgment in a critical case affecting the leadership and electoral participation of the African Democratic Congress (ADC).

In a letter dated April 28, 2026, the law firm of S.E. Aruwa, SAN & Co., acting as counsel in the matter, appealed to the Chief Justice of Nigeria to fast-track judgment in Suit No. SC/CV/180/2026, which involves David Mark versus Hon. Nafiu Bala Gombe and four others.
The legal team, also representing the ADC as the second respondent, warned that any delay could jeopardize the party’s ability to participate in the 2027 general elections.
According to the letter, the appeal was heard on April 22, 2026, and judgment was reserved. However, the lawyers stressed that developments following a lower court ruling have already triggered moves to de-recognize the party’s leadership, creating uncertainty within the ADC.
They further drew attention to the timetable released by the Independent National Electoral Commission (INEC), noting that ongoing electoral processes make it imperative for the Supreme Court to act swiftly.
The legal team cautioned that failure to deliver judgment within a short timeframe could exclude the ADC from the 2027 elections, potentially disenfranchising millions of Nigerians and infringing on their constitutional rights.
Describing the situation as urgent, the lawyers emphasized that “justice delayed… would amount to justice denied,” urging the court to intervene promptly to prevent what they termed irreparable political and legal consequences.
