The Federal High Court in Abuja has ruled against the legitimacy of Professor Pat Utomi’s proposed shadow government, describing it as illegal, unlawful, and unconstitutional.

Delivering judgment on a suit filed by the Department of State Services (DSS), Justice James Omotosho held that the idea of a shadow government or cabinet has no place in Nigeria’s presidential system of government.

The court issued an order restraining Prof. Utomi and his associates from proceeding with their plans, ruling that their rights to freedom of association and expression cannot be used as cover for actions deemed unlawful.

Justice Omotosho emphasized that the concept of a shadow government is alien to Nigeria’s constitutional framework and could undermine the nation’s governance structure. He further commended the DSS for bringing the matter before the court, stressing that the agency has the mandate to take proactive steps to safeguard national security.

With this ruling, Prof. Utomi and his allies are barred from forming any parallel structure resembling a government within the country.
